Privacy policy

How the centre collects, stores and protects your personal and health information.

Who this policy covers

Auckland Day Surgery Centre Limited is a health agency under New Zealand law. We handle your personal and health information in accordance with the Privacy Act 2020 and the Health Information Privacy Code 2020. This policy explains what the centre collects, why, who we share it with, how we keep it safe, and your rights.

The centre is a day surgery facility. It is not your surgeon’s practice. Your surgeon, your anaesthetist and the centre are separate agencies under the Privacy Act, and each holds its own records about your care. That is the same separation you see in your accounts, which come to you separately.

This policy covers only the information the centre itself holds. For the records your surgeon or your anaesthetist holds, including your surgical record, ask them directly. Their own privacy policies apply to those records.

Information we collect

To admit you safely and give you an anaesthetic, the centre collects personal and health information. This includes your contact and identifying details; the health information you or your surgeon give us before admission, such as your medical history, current medications, allergies and previous anaesthetics; the anaesthetic record made during your procedure; the nursing and recovery notes made while you are with us; and the details we need to invoice you for the facility.

The centre does not hold your surgical record. That is made and kept by your surgeon.

When you use this website, we collect no personal information at all. See "Cookies and this website" below.

How and where we collect it

Most of the information the centre holds about you does not come from you directly. It comes from your surgeon’s rooms when your procedure is booked, because your care begins there and the centre is the facility where it takes place. We may also receive information from your anaesthetist, from a hospital or specialist involved in your care, and from ACC or your insurer where it is relevant to your admission.

Where the centre collects information about you from someone other than you, we take reasonable steps to make sure you know that we hold it and why, as the Privacy Act 2020 requires. In practice, that is what this policy is for.

We also collect information directly from you: on admission, in your pre-admission health questionnaire, in conversation with the nursing and anaesthetic team, and when you contact us.

Why we collect it

The centre uses your information to admit you safely; to plan, give and monitor your anaesthetic; to care for you in recovery and decide when you are ready to go home; to communicate with your surgeon, your anaesthetist and the other clinicians involved in your care; to invoice you for the facility; and to meet our legal and professional obligations.

Whether you have to provide it

Providing your information is voluntary. However, some of it is needed to give you an anaesthetic safely. If we do not have it, your procedure may need to be postponed.

Who we share it with

The centre shares your health information only with those who need it for your care, or where the law requires or permits it. This includes your surgeon and your anaesthetist; other clinicians directly involved in your treatment; a hospital or emergency service if you need care the centre cannot provide; ACC or your insurer where you have asked us to, or where it is relevant to your claim; and regulatory or oversight bodies where we are required to respond, such as the Health and Disability Commissioner, the Medical Council of New Zealand, or the Privacy Commissioner.

The centre does not sell your information, and does not use it for advertising.

Communications

The centre contacts you about your admission and your care. Your appointment is arranged by your surgeon’s rooms, so most correspondence about the date and time of your procedure comes from them rather than from us. The centre does not send marketing communications.

Cookies and this website

This website sets no cookies. It does not use advertising or cross-site tracking, and it does not ask you to accept anything before you read it.

We measure how the site is used in an aggregated, anonymous way that identifies no individual and stores nothing on your device. New Zealand law does not require a cookie consent banner, and this site would not need one even if it did.

Storing and protecting your information

Your information is held securely, and access is limited to the people who need it to care for you or to run the centre. We use electronic, operational and physical safeguards appropriate to the sensitivity of health information.

Some of the services used to run the centre and this website store information on secure servers, which in some cases are located outside New Zealand. Where that happens, we take reasonable steps to ensure your information is protected to a standard comparable to New Zealand privacy law.

If something goes wrong

If a privacy breach occurs that is likely to cause serious harm, the centre will notify the Office of the Privacy Commissioner and the people affected as soon as we reasonably can, as the Privacy Act 2020 requires.

Accessing and correcting your information

You have the right to ask for a copy of the information the centre holds about you, and to ask us to correct it if it is wrong. We will respond as soon as reasonably practicable, and within 20 working days. If we do not agree to a correction, you can ask us to attach a statement of the correction you requested.

If you want your surgical record, ask your surgeon. The centre holds its own admission, anaesthetic and recovery records, and cannot give you records it does not hold.

How long we keep it

The centre keeps your health records for at least 10 years from the day after we last provided you with care, as the Health (Retention of Health Information) Regulations 1996 require. We may keep them longer where there is a clinical or legal reason to do so. When records are no longer needed, we dispose of them securely.
